By using this service, as well as the website and/or using of the technology, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern "Helping Our Seniors” relationship with you in relation to our website. If you disagree with any part of these terms and conditions, please do not use this service.

 

1. Terms

 

1.1 The term Helping Our Seniors or "us" or "we" refers to the volunteers of this website. The term "you" refers to the user or viewer of our website. The terms "Helping Our Seniors (volunteer)" refer to users of our technology, as defined below.

 

1.2 Helping Our Seniors volunteers our normal citizens who have registered for the service to assist a senior citizen in need of help during the Covid-19 pandemic. These volunteers have signed up to the Helping Our Seniors website and have agreed to be notified of seniors who need assistance in their area. Their actions are voluntary acts and they must respect the law as governed in their locale.


 

2. Liability:

 

2.1 "Helping Our Seniors Volunteers" undertake voluntary acts in good faith as independent citizens. Neither they nor Helping Our Seniors are liable for actions or omissions that result from the volunteer efforts they provide or are unable to provide. Helping Our Seniors is an altrustic operation run by volunteers who cannot be held liable for any injury or misadventure that occurs to either the volunteer, or any other person as a result of the use of this website; this includes but is not limited to issues relating to the malfunction of our services, or location inaccuracies and clinical matters arising from the action or inaction of a Helping Our Seniors user.

 

2.2 Helping Our Seniors volunteers must establish indemnity requirements for their country and profession. Many countries / regions have a "Good Samaritan" law that protects volunteers who respond to people in life threatening conditions. Some organisations (e.g. National Health Litigation Services) cover people that work within their national health service. If not covered by such mechanisms (e.g. you a doctor working privately) then check with your medical indemnity provider to ensure you are covered for Good Samaritan acts.

 

2.3 Helping Our Seniors does not seek financial remuneration from the use of this service or from either Volunteers or Seniors and no financial remuneration will be provided to Volunteers or Seniors either for perceived failures in the system or for acts performed.

 

2.4 If you are a volunteer and have restrictions for working with children / vulnerable / elderly then you must declare and de-register from Helping Our Seniors immediately. At no time should a senior and a volunteer have contact with each other. 

 

3. Terms of use

 

3.1 The use of our technology, our services and this website is subject to the following terms of use:

 

3.2 Helping Our Seniors is a voluntary service set up to provide assistance to senior citizens during the Covid-19 pandemic. 

 

3.3 The use of our technology, either as a Helping Our Seniors volunteer or as a senior in need of assistance, is entirely at your own risk, for which we shall not be liable.

 

3.4 Helping Our Seniors is voluntary. You must not seek payment, gifts, benefits or hospitality in relation to your involvement with the service.

 

3.5 Helping Our Seniors is run entirely by volunteers and not medical professionals. Please keep up to date with the latest Covid-19 related guidelines and advice from your local government. 

 

4. Volunteer Responsibilities and Agreement:

 

4.1 It is the responsibility of the individuals who register as a Helping Our Seniors volunteer to ensure that their registration with the relevant governing body is current and that they have up to date ID. If a volunteer is under any restriction or investigation or has any restrictions on working with children or vulnerable people they must de-register from the system. Users who exhibit any form of exploitative behaviour will be removed from the system and where applicable reported to their local authorities. ID is requested from volunteers as a security measure to ensure our seniors are protected. 

 

4.2 If a user fraudulently attempts to register as a volunteer, then they will be reported to the local legal force to deal with such fraud and barred from using Helping Our Seniors.

 

4.4 Before attending to assist a senior you MUST ensure you have accepted and agreed to following the Helping Our Seniors safety tips.. If in doubt, about your health or your ability to adhere to the safety tips please do not assist a senior. Helping Our Seniors cannot be held liable for any personal injury or loss that occurs as a result of volunteering to assist a senior.

 

4.5 By registering as a volunteer, you agree that you have read and will abide by the Helping Our Seniors safety guidelines. 

 

5. Responsibilities and Agreement for Seniors seeking assistance:

 

5.1 The Helping Our Seniors service is for seniors in need of assistance and the vulnerable ONLY. Any one who registers in order to manipulate, profit or fraud a volunteer will be immediately reported to the local authorities. 


 

5.2 You understand that Helping Our Seniors and their volunteers are performing "Good Samaritan" acts in good faith. Under no circumstances, if you have used the technology, will you pursue any medico-legal or other claim against Helping Our Seniors or the volunteer.

 

6. Misuse of Helping Our Seniors service:

 

6.1 All Helping Our Seniors volunteers are required to provide proof of identification. This is solely for preventing any fraudulent or criminal activity towards the vulnerable. Any action deemed inappropriate by a volunteer will result in their banning from all future use of the service. If an action is deemed criminal the volunteer will be reported to their local authorities.  Further legal action may be taken against the user if appropriate.
